1. Sweepstakes Period: The Sound Byte Sweepstakes (the “Sweepstakes”) begins at 12:00:01 p.m. Eastern Time (“ET”) on May 5, 2008 and ends at 11:59:59 a.m. ET on June 1, 2008 (“Sweepstakes Period”).
2. How To Enter: During the Sweepstakes Period, visit www.ListerineKids.com (the “Website”), complete all required registration information and submit an optional story (a “Story”), in 250 characters or less, describing one of your child’s funny excuses, word blunders or bloopers, and you will be automatically entered into the random drawing. Submitted Stories (or portions thereof) may be posted on the Website after they have been screened by Sponsor. Any Story deemed inappropriate or unsuitable, in Sponsor’s sole discretion, will be disqualified. Any Story or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright or trademark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be posted. Please do not include your child’s last name or any personally identifiable information (such as address or school name) in the Story. Limit one entry per person and per email address per day. Multiple entries received from any person or e-mail address after the first entry received from that person or email address in any given day will be void. Normal Internet access and usage charges imposed by your Internet service provider will apply. Entries generated by script, macro or other automated means will be void. Entries must be submitted by 11:59:59 a.m. ET on June 1, 2008 to be included in the random drawing.
3. Random Drawing: Potential winners will be selected on or about June 11, 2008, in a random drawing from among all eligible entries received. Drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning the prize will depend upon the total number of eligible entries received. Prizes will be awarded and potential winners will be notified by phone, mail and/or email.
4. Prizes, Manufacturer’s Suggested Retail Price (“MSRP”) and Approximate Retail Value (“ARV”): Grand Prize (1): A 2008 Toyota Highlander Hybrid with all factory standard equipment plus option package “A”, which includes the popular package, tonneau cover, cargo mat, and front dual zone automatic digital climate control (MSRP: $37,925). Color at sole discretion of Sponsor. Any additional and available vehicle options that are not standard on make and model of vehicle listed in prize description are the sole expense of winner. Winner is solely responsible for all applicable taxes, insurance, licensing, registration, title fees and pick-up costs. Winner may be required to show proof of insurance and a valid U.S. driver’s license prior to taking delivery and pick up vehicle as directed by Sponsor. First Prize (2): A MacBook Pro 15” 2.5 GHz (ARV: $2,499 each). Second Prize (5): A Panasonic 8.5” portable DVD Player (ARV: $220 each). Third Prize (1,000): A coupon for a 500 ml Listerine Smart Rinse (ARV: $5.99 each). Coupon is subject to terms and conditions specified thereon. Coupon expires 12/31/08. Total ARV of all prizes: $50,013. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Winners are responsible for all federal, state and local taxes as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Prizes are nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to award prize of equal or greater value, at its sole discretion. 5. Eligibility: Open only to legal residents of the 50 United States, including the District of Columbia, who, as of date of entry, are 21 years of age or older. Employees of Johnson & Johnson Consumer Products Company Division of Johnson & Johnson Consumer Companies, Inc., and any of their respective parent, subsidiary, and affiliate companies and advertising and promotion agencies, including Don Jagoda Associates, Inc., any of their affiliates, subsidiaries, advertising and promotion agencies, and all of their immediate family members (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible. Void where prohibited by law and subject to all applicable federal, state and local laws.
6. General Rules: Potential Grand and First Prize winners will be required to sign and return an Affidavit of Eligibility, Liability/Publicity release (where legal) within seven (7) days of date of notification attempt or prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected. Return of a prize or prize notification, Sponsor’s inability to contact a potential winner within a reasonable time period or noncompliance with these Official Rules may result in disqualification and, at Sponsor’s discretion, an alternate may be selected. All material submitted becomes the sole property of Sponsor and will not be returned. Acceptance of prize constitutes permission to the Sponsor and its agencies to use winner’s name, biographical information, city, state, pictures/portraits, likeness and/or voice, for purposes of advertising and trade in any and all media now or hereafter devised worldwide in perpetuity, without further compensation, permission, or notification, unless prohibited by law. By entering, entrants agree to hold Sponsor, its parent, affiliates, subsidiaries and advertising and promotion parties, and all of their respective directors, officers, employees and assigns (collectively, “Released Parties”), harmless against any and all claims and liability arising, in whole or in part, directly or indirectly, out of participation in this Sweepstakes or acceptance, use or misuse of any prize (including any injury or harm resulting from use of the vehicle). By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters. Released Parties are not responsible for late, lost, incomplete, inaccurate, delayed, misdirected or garbled entries, technical hardware/software failures of any kind, lost/unavailable network connections, or failed/incomplete, garbled or delayed computer transmission, which may limit a user’s ability to participate or for any other errors or problems of any kind relating to or in connection with the Sweepstakes, whether computer, network, technical, printing, typographical, human or otherwise, including, without limitation, any errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. Sponsor reserves the right to cancel/modify the Sweepstakes or disqualify entrant (and void all associated entries) if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes as determined solely by Sponsor. In the event of termination, a notice will be posted and, at Sponsor’s discretion, a random drawing will be held to select the winners from all non-suspect, eligible entries received prior to the time of termination. Attempt by an individual to deliberately damage Website or undermine legitimate operation of Sweepstakes is a violation of criminal/civil laws and should such attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such individual to the fullest extent of the law. Entries will be declared made by the authorized account holder of the email address submitted (who must comply with these Official Rules) and any damage made to Website will be responsibility of same. Authorized account holder is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. Released Parties are not responsible for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Sweepstakes. As a condition of entering the Sweepstakes, participant agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event will participant be entitled to receive attorneys fees or other legal costs. By submitting an entry that includes a Story, you represent: (a) that the Story is true and your own original work that has not previously been published or publicly shown or won a prize or award; (b) all rights to the Story belong to you and that you have the right to grant the rights set forth herein, and (c) the Story does not infringe, misappropriate or violate the rights of any third party. By submitting an entry that includes a Story, you agree Sponsor and its designees shall have the right to exploit, edit, modify, and distribute the entry and all elements of such entry (including the Story), including, without limitation, the names and likenesses of any persons embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to you or any third party.
